Divi Food and Beverages, a proprietorship operating the brand NXTCHA (“Company”, “we”, “us”), respects your privacy. This Privacy Policy explains how we collect, use, store, share and protect your personal data when you use www.nxtcha.com (“Website”). It is framed in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023.

We may collect the following:

  • Account and identity information: name, email address, phone number, and account login credentials (password stored in encrypted form).
  • Delivery and billing information: shipping address, billing address and related contact details.
  • Order information: products purchased, order history, personalisation messages, discount codes and Store Credit balances.
  • Payment information: payments are processed by Razorpay. We do not store your full card, UPI or banking details. We receive only transaction confirmation details such as transaction ID, amount and status.
  • User Content: reviews, ratings, testimonials and any communications you send us.
  • Technical information: IP address, browser type, device information, pages visited and similar data collected automatically through the Website and standard cookies necessary for its operation.

3. How We Use Your Information

We use your personal data to:

  • create and manage your account;
  • process, fulfil, deliver and track your orders;
  • process payments, refunds and Store Credit;
  • communicate with you regarding orders, support requests and service updates;
  • personalise gift boxes and handle bulk or corporate orders;
  • display your reviews and testimonials on the Website;
  • detect and prevent fraud, misuse and security incidents;
  • comply with legal obligations, including tax and food-business regulations; and
  • improve the Website and our products.

4. Cookies and Tracking

4.1 The Website uses cookies that are essential for its functioning, such as maintaining your session, cart and login.

4.2 We do not currently use analytics, advertising pixels or marketing trackers. If we introduce tools such as Google Analytics, Meta Pixel, Google Ads, email, SMS or WhatsApp marketing in the future, we will update this Policy and, where required, obtain your consent.

We do not sell your personal data. We share it only as necessary with:

  • Payment gateway: Razorpay, to process payments.
  • Delivery partners: local courier and delivery partners, to deliver your orders (name, address, phone number).
  • Service providers: hosting, technology and platform providers (including our Odoo-based platform) who support the Website under confidentiality obligations.
  • Legal and regulatory authorities: where required by law, court order, or to protect our rights, safety and property, or to prevent fraud.
  • Business transfer: in the event of a restructuring, sale or transfer of the business, your data may be transferred to the successor, subject to this Policy.

These third parties process your data under their own privacy policies and are expected to maintain adequate safeguards.

6. User Reviews and Public Content

Reviews and testimonials you submit may be publicly displayed on the Website along with your name or display name. Do not include sensitive personal information in them. You may request removal of your review by writing to us.

We retain your personal data for as long as your account is active or as necessary to fulfil the purposes described in this Policy, and thereafter for as long as required for legal, tax, accounting, dispute-resolution and regulatory purposes. Data is deleted or anonymised when no longer needed.
